On 29 May 2025, the Ministry of Environment announced the draft amendments to the Resource Recycling Act, which is set to be renamed the Resource Circulation Promotion Act, aiming to strengthen resource circulation. Among others, we summarize the bill below:
1.With reference to the European Union’s 2024 Ecodesign for Sustainable Products Regulation (ESPR), the amendments authorize the competent authority to stipulate green design guidelines for products and construction works, and may designate specific products or construction works to comply with such guidelines so as to enhance durability, reduce waste, etc. (Amended Articles 13 to 16)
2.The competent authority may designate the goals and methods of the repeated use of packaging and containers of specific articles for the manufacturers, importers or sellers to propose the repeated use plans and report the implementation results. (Amended Article 17)
3.The competent authority may designate specific enterprises and the reduction targets and methods of packaging and containers of specific articles for designated enterprises to propose the reduction plans and report the implementation results. (Amended Article 18)
4.The competent authority may prohibit or restrict the manufacture, import, sale or use of articles or their packaging and containers that excessively consume energy or resources or that contain components of long-lasting non-degradable or hazardous substances. (Amended Article 19)
5.The competent authority may designate the reduction goals for packaging used for the transportation, display or sale of specific articles for manufacturers, importers or sellers to report the reduction results. (Amended Article 20)
6.The competent authority may designate the goals and methods for extending the lifespan of specific articles for enterprises to report the implementation results. (Amended Article 21)
7.The competent authority may designate manufacturers, importers or sellers of specific articles to disclose information such as the proportion of recycled pellets (or materials) used and the methods of reuse. (Amended Article 23)
