Amendments to the Act of Gender Equality in Employment and Employment Insurance Act

On 12 January 2022, the Taiwan President announced the amendments to the Employment Insurance Act (“EIA”) and the Act of Gender Equality in Employment (“AGEE”), which took effect on 14 January and 18 January respectively this year. We summarize below:

1.The number of paid check-up leaves and paternity leaves respectively is increased from 5 to 7 days. In addition, the employer may apply with the Bureau of Labor Insurance for subsidy of payment for the leaves in excess of 5 days. (Article 15 of the AGEE)

2.The employee employed by an employer with less than 30 employees may negotiate and reach an agreement with the employer to reduce 1 working hour per working day (with no payment) or adjust the working hours. (Article 19 of the AGEE)

3.The application for the unpaid parental leaves and family caring leaves is no longer conditioned on that the applicant’s spouse must be unemployed. (Article 22 of the AGEE was abolished)

4.If the parents are both eligible as the insured under the EIA, they may simultaneously apply for insurance payment of unpaid parental leaves allowance. (Article 19-2 of the EIA)
